Foxborough has a great deal of protected land for a town of about twenty square miles: the 700-acre F. Gilbert Hills State Forest, some 1,700 acres of town conservation land, and the Neponset Reservoir. Many yards border woods, brooks or wet ground, and the town’s rules for building near them go further than the state’s.

Twenty-Five Feet From a Wetland, No Exceptions for Patios

Foxborough’s wetlands bylaw bars building, filling or altering land within 25 feet of a bordering wetland or the bank of a stream or pond, apart from upkeep of what is already there. New homes cannot go within 100 feet of a certified vernal pool.

The town’s named waters include the Neponset Reservoir, the Canoe, Wading and Rumford rivers, and Cocasset and Robinson brooks. If one of them is near your lot line, the Conservation Commission is the first call.

The Water Resource District Caps Hard Surface

Foxborough’s Water Resource Protection Overlay District covers the land that recharges the town’s wells, and a 250-foot band around bodies of water. Inside it, impervious surface is capped at 15 percent of a lot or 2,500 square feet, whichever is greater, unless the runoff is put back into the ground.

That makes drainage part of the design for a large patio, pool deck or driveway. Permeable pavers and dry wells are two ways to stay within the rule.

Check the Street Before You Plan a New Driveway

Any work in the town’s right-of-way, new driveway installations included, needs both a street cut permit and a trench permit from Public Works. The town also bars openings in a street that was paved within the past five years, and keeps a list of those streets.

Look at the street cut permit page before you count on a second driveway opening or a relocated apron.

Where a Pool Can Sit

Foxborough’s zoning lets a pool that belongs to a single- or two-family home sit within 15 feet of a side or rear lot line, and limits accessory buildings and structures to 25 percent of the rear yard. A pavilion or pool house counts toward that figure.

Building permits are applied for through the Inspections Department’s online portal; the counter no longer takes paper applications.

Foxborough, MA: How close to the lot line can a pool go in Foxborough?

The zoning bylaw allows a pool that is accessory to a single- or two-family home within 15 feet of a side or rear lot line. Wetlands, the septic system and the water resource district can each push it further in, so the real answer comes from a plan of your lot.

Foxborough, MA: Is my Foxborough home on sewer or septic?

It depends on the street. Public sewer serves limited parts of Foxborough and much of the town is on septic, so check with the Water and Sewer Division or the Board of Health. A septic system has to be located before a patio, pool or driveway is laid out.

Foxborough, MA: Who fixes a driveway apron damaged by the town plow?

In most cases the owner. Foxborough’s snow removal bylaw says driveway-apron damage from plowing is generally not repaired by the town, and that clearing the end of the driveway is the owner’s job. A well-built apron with a firm edge stands up to it better.
